INTRODUCTION

This End User License Agreement (EULA) governs the use of the video game “Para//ele : Silence is loud ” (hereinafter referred to as “the Game”) published by Lunary Games. By downloading, installing or otherwise using the Game, you agree to the terms and conditions of this EULA.

If you do not agree to the terms and conditions of this EULA, you are not authorized to use the Game.

The Game is offered on the Steam and Epic Games Store platforms. To play the Game via Steam, you must have a Steam account and accept the Steam Subscriber Agreement, available online at this address: https://store.steampowered.com/subscriber_agreement/ . To play the Game via the Epic Games Store, you must have an Epic Games account and accept the Epic Games User Agreement, available online at this address: https://store.epicgames.com/eula . In the event of any conflict between this EULA and the Steam or Epic Games Store subscription agreements, the latter shall prevail. If you purchase the Game on Steam, you will also need to have an Epic Games account in order to play the Game on that platform due to the cross -platform requirement .

You are permitted to use the Game and provide your personal data (such as your SteamID , EpicGameID , geographic location and nickname) only if you are 18 or older, or if you are 13 or older and your parent or legal guardian has read this EULA and has given you consent to use the Game.

SUMMARY OF LICENSE TERMS
  • This EULA constitutes a legal agreement between you and Lunary Games. By using the Game, you agree to the terms and conditions of this EULA.
  • The Game is currently in ” Early Access” and may therefore contain bugs or errors. It is provided “as is”.
  • Lunary Games reserves the right to change the terms and conditions of this EULA at any time without notice.
  • In case of violation of the terms and conditions of this EULA, Lunary Games reserves the right to prohibit you from using the Game and to request the intervention of its lawyers.
USE OF THE GAME

This EULA grants you a limited, non-exclusive, non-transferable, revocable, unwarranted license to play the Game on your computer or mobile device, provided you comply with the terms and conditions of this EULA. You are not permitted to use the Game for any other purpose, including but not limited to:

  • the reproduction, distribution, sale or commercial exploitation of the Game or any content included in the Game (such as graphics, characters, music, etc.), unless you have obtained prior written permission from Lunary Games ;
  • the use of any program, tool, method or technique aimed at altering the operation of the Game or circumventing its protections;
  • accessing or using any part of the Game for purposes that are illegal or prohibited by applicable laws and regulations;
  • sending any offensive, defamatory, discriminatory, hateful or otherwise unlawful or inappropriate content through the Game or in connection with the Game.

Lunary Games reserves the right to remove or edit any inappropriate or illegal content posted through the Game. If you post content to the Game, you must comply with the rules of conduct set forth in this EULA and any other documents posted by Lunary Games.

PERSONAL DATA

By using the Game, you may provide us with certain personal data, such as your SteamID , EpicGameID , geographical location and nickname. This data is used by Lunary Games in order to provide you with the Game and related services, as well as to improve and personalize your gaming experience. Lunary Games may also use this data for statistical and analytical purposes, targeted advertising and marketing.

WARRANTIES AND LIMITATIONS OF LIABILITY

You warrant to Lunary Games that you have all necessary rights, powers, permissions and licenses to accept this EULA and use the Game in accordance with the terms and conditions of this EULA.

You are solely responsible for all activities that occur under your account and you must protect your password and account from unauthorized access. You must immediately notify Lunary Games of any loss of your password or any unauthorized access to your account.

All warranty claims or claims must be made within 30 days of the date of purchase of the Game. Beyond this period, no warranty claims or claims will be accepted.

Lunary Games cannot be held responsible in the event of force majeure, fortuitous event or any other event beyond its control, which would prevent the proper execution of this EULA.

This EULA does not create any employment, partnership, franchise or joint venture relationship between you and Lunary Games.

This EULA constitutes the entire agreement between you and Lunary Games with respect to the subject matter of this EULA and supersedes all prior or contemporaneous communications and proposals, whether oral or written. If any provision of this EULA is held to be unlawful, void or unenforceable, that provision shall be deemed severable from this EULA and shall not affect the validity and enforceability of any remaining provisions.

This EULA is drafted in the French language and any translated version of this EULA is provided for informational purposes only. In case of discrepancy between the French version and any other translated version, the French version will prevail.

RESPONSIBILITY

The Game is provided “as is” and “as available”, without warranty of any kind, express or implied. Lunary Games does not warrant that the Game will be free from bugs or errors, or that you will be able to use the Game without interruption or without problems. Lunary Games also makes no warranty that the Game will meet your expectations or needs.

You use the Game at your own risk. Lunary Games cannot be held liable for any direct, indirect, incidental, consequential or other damage arising from the use of the Game or the impossibility of using it. This liability includes, but is not limited to, damage to your computer, mobile device or other equipment, as well as loss of profits, data or any other loss of intangible property.

Lunary Games shall not be liable for the actions or omissions of any third parties, including other players in the Game or any users of third-party services related to the Game (such as game servers or payment providers).

BANNING

Lunary Games reserves the right to temporarily or permanently ban any user who violates the terms and conditions of this EULA, acts inappropriately, or violates any applicable laws or regulations. Lunary Games also reserves the right to remove any user-generated content and to terminate any user’s use of the Game for violation of this EULA. Lunary Games reserves the right to determine, in its sole discretion, whether any conduct constitutes a violation of this EULA. Banned users will forfeit all benefits, points and other rewards associated with their account. Lunary Games is not responsible for any harm caused to the user as a result of being banned.

I suggest you make sure this paragraph is consistent with your banning policies and make sure you have fair and transparent procedures for handling ban cases. Please feel free to ask me questions if you need further guidance or clarification.

RESPECT FOR OTHER PLAYERS

You are expected to respect other users of the Game and not disrespect, insult or harm them in any way. You are also responsible for complying with all applicable laws and regulations and not using the Game in an illegal or inappropriate manner. Lunary Games reserves the right to take appropriate action in the event of non-compliance with these rules, including temporary or permanent banning of the user.

I suggest that you add this section to your End User License Agreement to clearly define expectations for behavior and respect for other players. MODIFICATION OF THE GAME AND THIS EULA

Lunary Games reserves the right to modify, improve or discontinue any aspect of the Game, including features, appearance, interfaces and content, without notice and without obligation on your part. Lunary Games also reserves the right to change the terms and conditions of this EULA at any time without notice.

TERMINATION OF LICENSE

Lunary Games reserves the right to terminate your license to use the Game at any time without notice for any reason. Upon termination of the license, you must immediately cease all use of the Game and destroy all copies of the Game in your possession.

APPLICABLE LAW AND JURISDICTION

This EULA is governed by the laws of France. Any dispute arising out of or in connection with this EULA will be subject to the exclusive jurisdiction of the courts of Paris.

ACCEPTANCE OF THIS EULA

By using the Game, you agree to the terms and conditions of this EULA. If you do not agree to the terms and conditions of this EULA, you are not authorized to use the Game.
